Jack Smith has had enough of Trump's BS
Special Counsel Jack "Be Nimble, Be Quick" Smith was rather busy yesterday.
He began the day by filing a petition with the Supreme Court to bypass a long, drawn-out litigation process on the part of criminal defendant Donald Trump and have it rule immediately on Trump's novel theory that as president he had completely immunity for all his actions while in office. If the Court were to agree to this novelty the January 6th case would be thrown out.
Now, before you go doom, if SCOTUS were to agree to this, this would be a plausible outcome:
Now, if a schlub on social media can figure this out, then it's safe to say that so could at least five of the nine justices. Of course, Pres. Biden wouldn't do this. But he'd be fully within his rights were the court to rule in Trump's favor to do just that—including incarcerating Trump. While the probabilities are not zero that the Court will rule in Trump's favor, they do tend towards that direction, considering that it has not backed Trump in any of his appeals since 2020.
Hours after Smith filed his petition, the Court responded by stipulating an accelerated argument. Now, this is all reading tea leaves, but again it's unlikely that even this court will rule that Donald Trump and all other presidents are immune from prosecution for crimes committed while in office. The alacrity with which the court responded is a good sign that Smith will quash Trump's shenanigans.
Why did he make this move? Because he saw where this was going. Trump was just going to delay and delay. It was best to rip off the Band-Aid and take it directly to SCOTUS in an effort to keep the trial on track for beginning on 4 March 2024.
And oh boy, the news that broke at the end of the day shows just how screwed Trump is.
Special counsel Jack Smith has extracted data from the cell phone Donald Trump used while in the White House and plans to present evidence of his findings to a Washington, D.C. jury to demonstrate how Trump used the phone in the weeks during which he attempted to subvert the 2020 election.
In a court filing Monday, Smith indicated that he plans to call an expert witness who extracted and reviewed data copied from Trump’s phone, as well as a phone used by another unidentified individual in Trump’s orbit.
The data from Trump’s phone could reveal day-to-day details of his final weeks in office, including his daily movements, his Twitter habits and any other aides who had access to his accounts and devices. The data, for example, could help show whether Trump personally approved or sent a fateful tweet attacking his vice president, Mike Pence, during the Jan. 6 riot at the Capitol.
This is turning into a CSI episode. As a commenter tweeted out:
Trump is the proverbial man falling out of a tall building who tries to flap his arms to fly because he has no other good option. He railed at Smith going to SCOTUS, depriving him of his precious appeals by which he hoped to drag this out. And the fact that the court responded very quickly agreeing to hear Smith's petition, in my eyes, is evidence that a solid majority has no interest in bailing him out by making presidents dictators in all but name, untouchable by the court system.Team Trump is going to get a lesson on geolocation services paired with corroborating eye witness testimony.

What we can say is that Jack Smith is not Robert "Bobby Three Sticks" Mueller III. Unlike the former FBI director, Smith is not afraid to "go there". He has Trump in his sights, almost as if personally offended that such a reprobate dared to attempt to overthrow the Republic. He is going balls-out to nail that motherfucker. And he and his team are orders of magnitude smarter than the collection of bus-bench lawyers Trump has. Again, I can't say that there's no chance that the court won't rule in Trump's favor. But if past is prologue, the past three years of Trump striking out repeatedly in front of the highest court in the land doesn't speak well for his prospects. It's very probable that the trial will begin on 4 March as scheduled, last six weeks, and at the end of that Trump will be a convicted felon.
So settle in kids. As I keep saying, we will win.
